This comes after Judge Neil Tuchten has refused the losing bidder – Gidani – permission to file an application for leave to appeal a previous ruling because its filing would have been late. In July, the court referred Ithuba’s licence back to trade and industry minister Rob Davies following Gidani’s application to have the award overturned.
