Rosewood hotel group had enough of Baha Mar’s “failure to perform”
Efforts to reboot the stalled $3.5b Baha Mar casino resort in the Bahamas took another hit last week after a major hotel chain said it wanted out of the project.
This past Thursday, Rosewood Hotels and Resorts International filed a motion in the Delaware court handling the bankruptcy of the project’s developer, Baha Mar Ltd. The developer filed for Chapter 11 protection in June after falling out with its primary contractor China Construction America (CCA) and its primary lender, Export-Import Bank of China (EXIM).
Rosewood, which is owned by Hong Kong-based New World Hospitality, wants relief from the automatic stay imposed by the Delaware bankruptcy court so that it can terminate the license agreement it signed with Baha Mar Ltd. in 2011.
Rosewood claims that its brand is being “diminished and tarnished each day as a result of its association with Baha Mar.” More to the point, Rosewood says it continues to incur “costs and expenses for which it is not being compensated” due to the developer’s “failure to perform and other incurable defaults,”

More junket layoffs in Macau as analysts attempt to quantify VIP sector
Macau casino junket operator Jimei Group has reportedly fired 20 employees and more layoffs are on the way due to decreasing action at its VIP gaming rooms.
On Tuesday, Macau Business Daily quoted Ieong Man Teng, president of casino labor union Forefront of Macau Gaming (FMG), who said he learned of the dismissals from two of the 20 workers who found themselves out of a job and requested assistance from FMG.
Ieong said most of those who got the sack were employees with bad performance records. But Ieong said there were also some Jimei staffers who’d been “unreasonably dismissed,” including those who recently returned to Macau following business trips.
Ieong noted that this latter group had been “compensated by their boss based on the labor law” but FMG was nonetheless discussing the matter with the Labor Affairs Bureau to see if there were any other actions that could be taken on behalf of the unreasonably dismissed staff.

Online lottery suspension dragging down China lottery sales, Alibaba revenue
China’s suspension of online lottery sales took a big bite out of July’s overall lottery sales revenue.
The Ministry of Finance says total lottery sales in July were RMB 27.1b (US $4.2b), a decline of 27.3% from the same month last year. Welfare lottery sales fell 10.6% to RMB 15.6b while sports lottery sales fell 42% to RMB 11.5b. For the first seven months of 2015, overall sales are down 0.4% to RMB 214.7b.
Just eight of China’s 31 lottery-selling provinces and cities reported sales increases in July, with Shanghai leading the decliners by falling 73.8% year-on-year. While some of the year-on-year decline can be credited to last year’s results having been boosted by the 2014 FIFA World Cup, the Beijing-ordered suspension of online lottery sales this spring is also having an effect.
The ‘temporary’ suspension, which has lasted nearly six months now, was sparked by allegations that unscrupulous provincial lottery administrators were failing to register all online sales and pocketing the difference. In June, the National Audit Office said lottery officials had misused RMB 16.9b ($2.8b) worth of the government’s share of lottery proceeds.

New Jersey loses sports betting fight (again) at Third Circuit Court of Appeals
A federal appeals court has rejected New Jersey’s latest attempt to bring legal sports betting to the Garden State.
On Tuesday, a three-judge panel of the US Third Circuit Court of Appeals ruled 2-1 against New Jersey’s appeal of a lower court’s ruling barring implementation of its latest sports betting legislation. The ruling (read it here) is the second time the Third Circuit has stymied the state’s plans to tear down the 1992 federal PASPA law that restricts legal sports betting to four states, and actual single-game sports betting to within Nevada’s borders.
In 2014, New Jersey passed legislation to repeal state-level prohibitions on sports betting at state racetracks and Atlantic City casinos. The state argued that this plan was fully in line with arguments by their opponents – the US Department of Justice, the four major pro sports leagues and the NCAA – that there was nothing in PASPA that prevented New Jersey from choosing not to enforce PASPA’s edicts so long as it didn’t expressly authorize or license betting operations.
